Trademarks and Medical Marijuana

Now that medical marijuana is allowed in Missouri, entrepreneurs may wish to start registering trademarks for marijuana-related businesses to protect the brands they hope to grow. However, profanity is not the only thing prohibited by federal trademark law. "Lawfulness of commerce" is another consideration when considering a mark for federal registration.

Consult legal counsel to make sure; that's what lawyers are for!  If services or products are marijuana-adjacent but federally legal, it may be possible to register a trademark with the U.S. Patent and Trademark Office.

For protection in Missouri only, trademark registration is easy and cheap.

For those looking to enter or already involved in the medical marijuana industry, the MoCannBizCon + Expo coming up in March looks like a good opportunity for networking and learning.
